The author analyzes the current state of regulation of the category “intelligent control” in the economic and legal sphere, which arises in both intentional and negligent crimes. The analysis carried out in the article shows that law enforcement officers and legislators should reconsider their approach to determining guilt in the case of using artificial intelligence systems to commit intentional crimes. Since the artificial intelligence system in some sense has its own advanced knowledge and will, courts cannot rely on the traditional concept of guilt in intentional crimes, where intent is clearly defined in accordance with the actions of the offender. Regulating robot liability for crimes is particularly problematic.
