Human rights and freedoms are the main value of our country, but their implementation has its own legal incidents. As in any other legal institution, there are gaps, the solution of which requires both scientific justification and practical elaboration. Along with this, it is the realization of personal rights and freedoms of a person and a citizen that is not so much of national importance as individual and personal, thus, it can be noted that each citizen reacts more acutely to problems concerning his person specifically, which later, often, acquires a great public resonance. To determine the directions of solving incidents, it is necessary to consider the problems themselves.
