The article investigates the formation of intellectual property law. The paper shows how the ideas of philosophers in the eighteenth century are reflected in legal theory and practice. It is demonstrate that the objectivist utilitarian doctrine served as a model for the formation of Anglo-Saxon system, and the subjectivist theory of natural rights was the basis for the Roman-Germanic system of copyright.
